PRIVACY POLICY

First Dance by Zienna LLC ("First Dance by Zienna," "we," "us," or "our") is a Florida limited liability company. This Privacy Policy explains what personal information we collect, how we use it, when it may be shared, and the choices and rights available to customers and website visitors.

1. Information We Collect

We may collect your full name, email address, account information, purchase history, and information you provide when contacting us. For new choreography orders, we also collect information needed to create and deliver the order, including your wedding date, selected song and version, choreography preferences, and any notes you choose to provide. You may voluntarily include other information in your notes, but we do not require health or medical information.

2. Payment and Billing Information

Payments and billing information are handled by Stripe and/or Thinkific. First Dance by Zienna does not need to directly store your full payment-card details. Those providers process information under their own privacy practices.

3. Practice Videos and Customer Content

If you voluntarily send us a practice video for feedback, we use it to provide that feedback and do not retain it afterward. Wedding videos, review videos, photographs, testimonials, or other customer content may be shared publicly or used in our marketing only when the customer has given us permission to do so.

4. How We Use Personal Information

We use personal information to process purchases, create and manage customer accounts, deliver course and choreography access, create new choreography orders, provide practice feedback and customer support, restore access when needed, communicate about purchases, prevent fraud or misuse, maintain appropriate business records, improve our products and services, and comply with legal obligations. We may also send marketing emails in the future where permitted by law. Marketing emails will include a way to unsubscribe.

5. Course Platform and Accounts

Our online content is delivered through Thinkific. Customers create personal accounts to access purchased content. Thinkific may process account, technical, course-use, and related information needed to operate the platform.

6. Advertising and Tracking

We use or may use advertising and tracking technologies from Meta (including Facebook and Instagram), TikTok, and Google. These technologies may collect device, browser, IP address, website activity, advertising-interaction, and similar information to measure advertising and show relevant ads. We do not sell customers' names or email addresses and do not provide them to another company for that company's own marketing. Some privacy laws may nevertheless define certain advertising-related disclosures or cross-context behavioral advertising as a "sale" or "sharing." Where required, we will provide the consent or opt-out choices required by applicable law.

7. Cookies

Our website and service providers may use cookies, pixels, and similar technologies for essential site functions, account access, advertising measurement, and marketing. Where applicable law requires consent before non-essential advertising or tracking technologies are used, we will obtain that consent. Our current website setup should be reviewed to ensure an appropriate cookie-consent mechanism is implemented where required.

8. When We Share Information

We may share information with service providers that help us operate our business, including Thinkific, Stripe, and advertising, technology, email, security, and professional-service providers. We may also disclose information when required by law, to protect our legal rights, to prevent fraud or misuse, or in connection with a business sale, merger, or reorganization. We do not sell customer personal information or give customer names or email addresses to other companies for their own marketing.

9. International Data Transfers

We are based in the United States and sell internationally. Personal information may therefore be processed in the United States or in other countries where our service providers operate. Where required by applicable privacy law, appropriate safeguards will be used for international transfers.

10. How Long We Keep Information

We do not currently use one fixed retention period for every type of record. We keep personal information only for as long as reasonably necessary to provide the service, maintain appropriate business and transaction records, meet legal and tax obligations, prevent fraud, resolve disputes, and protect our legal rights. Practice videos submitted solely for feedback are not retained after the feedback is provided.

11. Your Privacy Rights

Depending on where you live, applicable law may give you rights to request access to personal information, correction, deletion, restriction or objection to certain processing, data portability, withdrawal of consent, or an opt-out from certain targeted advertising or sharing. To make a privacy or account-deletion request, email [email protected]. We may need to verify your identity. We may retain information where the law permits or requires us to do so, including for tax, transaction, fraud-prevention, dispute, or legal purposes.

12. EU and UK Visitors

Where the EU GDPR or UK GDPR applies, we process personal information using an appropriate legal basis, which may include performing our contract with you, complying with legal obligations, our legitimate interests in operating and protecting the business, or your consent. Applicable users may have rights including access, correction, erasure, restriction, objection, portability, and withdrawal of consent. You may also have the right to complain to the relevant data-protection authority.

13. California Residents

Where the California Consumer Privacy Act, as amended by the CPRA, applies, California residents may have rights relating to access, correction, deletion, and certain sales or sharing of personal information. We do not sell customer names or email addresses. Advertising technologies may, in some circumstances, constitute "sharing" under California law. Applicable requests may be sent to [email protected], and we will not discriminate against a customer for exercising an applicable privacy right.

14. Canadian Customers

Where Canadian privacy law, including PIPEDA where applicable, applies to us, we will handle personal information in accordance with applicable requirements concerning consent, appropriate purposes, safeguards, access, correction, and accountability.

15. Australian Customers

Where Australia's Privacy Act and Australian Privacy Principles apply to us, we will handle personal information in accordance with applicable requirements, including requirements concerning collection, use, disclosure, security, access, correction, and overseas disclosures.

16. Marketing Emails

Customers may unsubscribe from marketing emails at any time. Unsubscribing from marketing does not prevent us from sending necessary service messages about purchases, account access, choreography orders, delivery, security, or other transactional matters.

17. Security

We take reasonable steps to protect personal information. No online service can guarantee complete security. Customers are responsible for keeping their account credentials private and should contact us if they believe their account has been accessed without permission.

18. Age Requirement

Our products are intended for adults. You must be at least 18 years old to purchase our products or create an account.

19. Changes to This Policy

We may update this Privacy Policy as our business, technology, or legal obligations change. The updated version will be posted on our website with a new effective date. We will provide any additional notice required by applicable law.

20. Contact

Privacy requests, account-deletion requests, and questions about this Policy may be sent to First Dance by Zienna LLC, Florida, United States at [email protected]. We do not publish a private residential address on this website.
